These Terms and Conditions apply to your use of this website and to everything you book or buy from The Berry Collective, of Blossom Yurt at Howgills Hideaway, Lowgill, Kendal LA8 0BT. They cover both of our sides: Bloom with Berry, which offers yoga, Ayurvedic Yoga Massage, sauna rituals and retreats, and Berry Poetic, which offers poetry, art and prints.
Sections 1 to 6 apply to the website and to any purchase. Sections 7 to 12 apply to bookings for experiences. Sections 13 to 15 add specific terms for Ayurvedic Yoga Massage, sauna and yoga, which apply in addition to everything before them.
By booking with us, or by using this website, you confirm that you have read, understood and agreed to these Terms and Conditions.
Nothing here limits your legal rights as a consumer under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
You may use this website for your own personal, non commercial purposes. You agree not to misuse it, attempt to gain unauthorised access to it, introduce anything malicious, or copy substantial parts of it for your own commercial use.
We work hard to keep the information here accurate and current, but we do not guarantee that it is complete or error free, and we may change or remove content at any time. We cannot guarantee uninterrupted availability of the website.
Descriptions, prices and availability shown on the website may change before you book. The terms and price that apply to you are the ones shown at the point of booking.
All poetry, artwork, photography, text, design and other content on this website belongs to The Berry Collective or is used with permission, and is protected by copyright. You may not reproduce, republish, sell or adapt it without our written consent.
When you buy a print, you are buying the physical item for personal enjoyment. Copyright in the poem or artwork remains with us, and the work may not be reproduced, used commercially or resold as a design.
If you share our work on social media, please credit The Berry Collective.
We take care over the images of our prints and products, but colours can vary slightly between screens and in print, and handmade items naturally vary a little. That variation is not a fault.
Where you buy a product from us, you may cancel within 14 days of receiving it and return it for a refund, provided it is unused and in a saleable condition. Return postage is at your cost unless the item is faulty or not as described. This right does not apply to items made or personalised to your specification.
If something arrives damaged or faulty, contact us within a reasonable time and we will put it right with a replacement or refund.
Some of our products are sold through Etsy. Purchases made there are subject to Etsy's own terms and returns process.
Gift vouchers are non refundable and are valid for the period stated on the voucher. They are not exchangeable for cash, and should be quoted at the time of booking. Bookings made using a voucher are subject to availability and to these terms in the usual way.
Our website links to other websites, including Howgills Hideaway, TryBooking, Etsy and our social media pages. We have no control over their content and are not responsible for it. Their own terms and privacy policies apply once you leave our website.
These terms form a binding agreement between you, the Guest, and us when you book any retreat, workshop, day retreat, sauna experience, bodywork session, yoga session or accommodation. We refer to all of these as an Experience.
A booking is confirmed once payment has been received and a confirmation email has been issued. Please check your confirmation carefully and tell us within 48 hours if anything is incorrect.
Bookings for experiences are taken through our booking provider, TryBooking. Until you have a confirmation email, no place is reserved.
Where a group booking is made, the person making the booking is the booking lead and is responsible for ensuring that everyone in the group understands and follows these terms.
Prices are in pounds sterling and include VAT where applicable.
Where possible, we may offer a transfer to a future date, subject to availability and at our discretion. This is not guaranteed.
We strongly recommend appropriate travel and cancellation insurance, particularly for residential retreats.
For goods bought from our shop, the 14 day right to change your mind in section 4 applies. For bookings of leisure activities on a specific date, the statutory 14 day cooling off period does not apply, which is why the cancellation terms above are what govern your booking.
In rare circumstances, such as illness, extreme weather or events beyond our control, we may need to cancel or reschedule.
If this happens, you will be offered either a full refund or the option to transfer your booking to a future date.
We cannot be held responsible for additional costs incurred, including travel, accommodation booked elsewhere or loss of earnings. Travel insurance is recommended, as above.
By booking, you confirm that you are physically and mentally able to participate in the Experience you have chosen.
You must inform us before arrival of any medical conditions, injuries, pregnancy, recent surgery, mental health considerations or anything else that may affect your participation.
Participation in all activities is optional. You are always encouraged to listen to your body, modify practices and rest when needed.
Nothing we offer is medical treatment, diagnosis or therapy, and it is not a substitute for advice from a qualified healthcare professional. You should not stop or change prescribed treatment on the basis of anything said in a session.
We may decline to let you take part, or ask you to stop, where we reasonably believe it would be unsafe for you or for others. Where we have to do this because information was withheld from us, no refund is due.
Residential retreats take place at a shared rural glamping site, Howgills Hideaway. Full accommodation details, arrival and departure times will be provided before your stay.
Guests are expected to treat the accommodation, yurt, sauna, shared facilities and surrounding land with care and respect. Any damage caused by a guest may be charged accordingly.
As this is a working rural environment, guests should be aware of uneven ground, wildlife, changing weather conditions and limited lighting. The site is reached by a farm track, so please allow extra travel time.
Howgills Hideaway is a separate business. Matters such as the condition of the accommodation, its facilities and site rules are their responsibility, and your stay is also subject to their terms.
We aim to create spaces that feel safe, welcoming and respectful.
Disruptive, unsafe or disrespectful behaviour may result in a guest being asked to leave without refund. This includes behaviour arising from intoxication. Phones should be switched off or on silent during sessions.
Please respect the privacy of other guests and do not photograph or record anyone without their permission.
While we take care to create safe and nurturing experiences, participation is at your own risk to the fullest extent permitted by law.
We are not responsible for loss, theft or damage to personal belongings.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
We cannot be held responsible for injury, loss or damage resulting from a failure to disclose relevant health information, or from practising beyond your own capacity.
Many Experiences take place outdoors or in nature based settings. Weather and environmental conditions may require changes to the schedule, and we reserve the right to modify or adapt activities to ensure safety and wellbeing.
We are not liable for failure to perform where it is caused by something outside our reasonable control, including severe weather, flooding, fire, power or water failure, illness, epidemic, restrictions imposed by government, industrial action, or loss of access to the site. Where this happens we will contact you as soon as we can and offer a transfer or a refund of what you paid us.
Ayurvedic Yoga Massage is a deeply therapeutic full body treatment using warm oils, assisted stretches and rhythmic pressure. It supports relaxation, mobility and overall wellbeing. This treatment is not a substitute for medical care.
Before your session you will complete a short health questionnaire and discuss relevant medical history. Please inform us if you have or are experiencing:
Some conditions may require the session to be adapted, postponed or declined. We reserve the right to stop or refuse treatment where it is not safe or appropriate.
Any inappropriate behaviour will result in the session ending immediately, with the full fee still payable.
You may experience tiredness, emotional release, light soreness or thirst. These are all normal responses. We recommend hydration, rest and gentle movement.
Sessions must be booked in advance, with full payment at the time of booking unless otherwise agreed. All personal and health information is treated with complete confidentiality and stored securely. Treatment may be refused or discontinued if it is unsafe, if health information is withheld, or if boundaries are not respected.
Sauna bathing and hot and cold therapy are powerful practices. Participation is voluntary and at your own responsibility. Sauna use is not a medical treatment.
The sauna host operates the stove at all times.
Medical advice must be sought before sauna use if you are pregnant, or have cardiovascular conditions, epilepsy, asthma or blood pressure issues, are prone to dizziness or fainting, or are taking medication.
Please do not use the sauna without seeking medical advice first if any of the above applies to you.
Sauna rituals may include essential oils, herbs or plants. Please inform us of any allergies in advance. Guests may not bring their own oils into the sauna.
Cold exposure in the cold plunge tubs is optional and undertaken at your own risk. Enter slowly, and exit immediately if you feel unwell.
Alcohol and nudity are not permitted.
Parking, changing space, hot drinks, water and showers are available, showers on request. Please bring towels, one to sit on and one to dry with, plus swimwear, dry clothes and suitable footwear for walking across the grass from the car park and between the sauna and the cold plunge tubs.
We reserve the right to refuse entry or to end a session where safety or conduct is a concern. In those circumstances refunds will not be offered.
These apply to all yoga sessions, both 1:1 private sessions and group classes.
You agree to take full responsibility for your own wellbeing during the session. You understand that yoga involves physical movement and that there is a risk of injury if it is practised incorrectly or beyond your personal limits. You agree to follow the guidance given during the session, and to modify, rest or stop if anything feels uncomfortable or unsafe.
1:1 sessions are tailored to your needs, intentions and experience level. While personalised guidance is offered, you remain responsible for how you engage with the practice. Please arrive on time to make the most of your session.
Group classes are open to mixed abilities unless otherwise stated. Modifications will be offered, but it is your responsibility to choose what feels right for your body. To protect the shared atmosphere of the group, late arrivals may not be admitted once the session has started. Spaces are limited and allocated on a first come, first served basis.
Please arrive a few minutes early to settle into the space. Missed sessions and late arrivals are non refundable.
Personal information is collected solely for booking, communication and delivery of Experiences, and is handled in line with our Privacy Policy. Health information you share with us is treated as special category data and handled with particular care. See also our Cookie Policy.
These Terms and Conditions are governed by English law, and any disputes will fall under the jurisdiction of the English courts. If you live elsewhere in the United Kingdom, you may bring proceedings in your own local courts.
We may update these terms from time to time. The version that applies to your booking is the one published when you made it. The date at the top of the page shows when these terms were last revised.
